Resum

O presente trabalho busca analisar os elementos normativos do direito dos cursos d’água internacionais, em especial no que se refere ao princípio do uso equitativo de recursos compartilhados e ao princípio da cooperação, com intuito de vislumbrar potenciais hipóteses de aplicação no caso Silala, querela envolvendo Chile e Bolívia, atualmente pendente de julgamento na jurisdição da Corte Internacional de Justiça. Para tanto, serão analisadas as perspectivas doutrinárias e jurisprudenciais acerca do desenvolvimento e aplicação desses princípios, de forma a orientar eventuais parâmetros a serem utilizados para sua aplicação no caso Silala. Por fim, o trabalho conclui que, independentemente da solução a ser adotada no caso concreto, a ausência de cooperação voluntária dos Estados litigantes para aplicar o princípio do uso equitativo e  o princípio da cooperação é prejudicial para ambos, assim como para o recuso hídrico em contenda.
