Aquest estudi ofereix una anàlisi del litigi climàtic davant el Tribunal Europeu de Drets Humans, amb especial atenció al cas KlimaSeniorinnen, que marca l’inici d’una nova línia jurisprudencial en aquesta matèria. Aquest pronunciament es basa en la doctrina ambiental prèviament desenvolupada pel Tribunal, però representa una evolució significativa en adaptar alguns dels seus enfocaments a les particularitats del canvi climàtic i incorporar aproximacions innovadores. Per primera vegada, es vincula expressament el canvi climàtic amb la protecció dels drets humans reconeguts en el Conveni Europeu de Drets Humans, concretament els articles 8 (dret al respecte de la vida privada, familiar i del domicili) i 6.1 (dret d’accés a un tribunal). De manera específica, en aquest treball s’examinen les obligacions positives que els Estats han d’assumir en virtut de l’article 8 segons aquest pronunciament, així com els reptes i l’impacte que comporta l’execució de la sentència, sotmesa a la supervisió del Comitè de Ministres del Consell d’Europa.
