Resum

Aquest article sosté que el desenvolupament progressiu dels drets i les obligacions relacionades amb les Avaluacions d’Impacte Ambiental (AIA) ofereix una perspectiva particularment valuosa per entendre la consolidació i transformació de la jurisprudència ambiental de la Cort Interamericana de Drets Humans. Per tal de traçar l'evolució jurisprudencial de les AIA, el treball revisa les aportacions de sis casos contenciosos entre 2007 i 2023, dividits en dues fases, abans i després de l’Opinió Consultiva núm. 23/2017. L’article conclou que la Cort ha transformat gradualment un instrument propi del dret ambiental en una garantia dels drets humans basada en l’obligació de prevenció, consolidant així la funció de les AIA com a pont entre la protecció del medi ambient i la realització dels drets humans.

Biografies de l'autor/a

Taciano Scheidt Zimmermann, University of São Paulo (USP)

PhD candidate in International and Comparative Law at the University of São Paulo (USP). Holds a Master’s degree in International Law and a Bachelor’s degree in Law from the Federal University of Santa Catarina (UFSC). Member of the Research Laboratory on International Environmental and Climate Change Law at the Federal University of Minas Gerais (UFMG). Brazilian career diplomat since 2020. Within the Ministry of Foreign Affairs, served as Assistant at the Human Rights Division (DDH) and as Deputy Head of the Human Rights Litigation Division (DCDH), in addition to a temporary assignment at the Permanent Mission of Brazil to the United Nations in Geneva (2022). Since 2024, heads the Energy and the Science, Technology, and Innovation sections at the Embassy of Brazil in New Delhi, India.

André de Carvalho Ramos, University of São Paulo (USP)

Professor at the Faculty of Law of the University of São Paulo (FDUSP), he holds the title of Livre-Docente and a Ph.D. in International Law from FDUSP. He was a Visiting Fellow at the Lauterpacht Centre for International Law (Cambridge) and is a member of the Brazilian Society of International Law (SBDI), the American Association of Private International Law (ASADIP), and the International Law Association (ILA – Brazilian Branch), where he served as Director from 2018 to 2022. He is the author of several works on Public International Law, Private International Law, and Human Rights, including: Curso de Direitos Humanos (8th ed., 2021), Curso de Direito Internacional Privado (2nd ed., 2021), Comentários à Lei de Introdução às Normas do Direito Brasileiro (co-authored with Erik Gramstrup, 2nd ed., 2021), Teoria Geral dos Direitos Humanos na Ordem Internacional (7th ed., 2019), and Processo Internacional de Direitos Humanos (6th ed., 2019), all published by Saraiva. He is a Regional Prosecutor in Brazil’s Federal Prosecution Service and served as National Coordinator of the Working Group on “Migration and Refuge” within the Federal Prosecutor’s Office for Citizens’ Rights (2020–2022). Since 2020, he has acted as an observer, on behalf of the Federal Public Ministry, before the National Committee for Refugees (Conare). He was the first Secretary for Human Rights of the Office of the Prosecutor General (2017–2019), the first National Coordinator of the National Executive Group for Electoral Function (2013–2015), Regional Electoral Prosecutor for the State of São Paulo (2012–2016), and Regional Prosecutor for Citizens’ Rights in São Paulo (2000–2002).
