Els reptes futurs en la protecció laboral i ambiental: més enllà de les fronteres

Resum

Quan parlem conjuntament de les proteccions “laborals” i “ambientals”, ja estem creuant les fronteres de disciplines jurídiques diferenciades, que han tendit a operar en paral·lel. La meva proposta és que cal considerar aquestes proteccions de manera conjunta. Això planteja dos reptes.

El primer és travessar els límits legals, fusionant diferents branques del dret. Aquesta missió podria implicar el redisseny del dret laboral i ambiental de manera substancial per tal que permetin la seva interacció, per exemple repensant l’estatus laboral i la nostra concepció del treball. Això també pot requerir la implicació d’altres disciplines i jurisdiccions jurídiques.

El segon repte és donar resposta als danys ecològics i laborals que traspassin fronteres geogràfiques. Aquí podem analitzar el contingut de les lleis internes que tenen efectes transfronterers i abordar les possibilitats d’una regulació transnacional efectiva. Aquest exercici exigeix reconèixer les complexes interconnexions entre disciplines jurídiques, així com valorar les seves múltiples interaccions superposades a través de les fronteres estatals.

Tots dos reptes plantegen qüestions profundes sobre la capacitat d’agència dels actors implicats en aquests processos. La reforma de les lleis processals –tant com les substantius– i de la seva aplicació pot oferir oportunitats, responent al desig d’actuar en solidaritat i fomentant la capacitat per fer-ho de manera efectiva.
