The Socioenvironmental Function of Rural Property: Building a New Proposal for the Resolution of Land Disputes in the South of the State Bahia, Brazil

Rich in natural resources, Brazil is a country of continental proportions facing major social problems, many of which linked to the unequal distribution of land. In this regard, much land in Brazil fails to meet the principles of rational and adequate use, in terms of productivity, preservation of the environment, and labor relations. This article outlines the legal framework governing the socioenvironmental function of property in Brazil and examines how the interested parties in land disputes in the south of the State of Bahia have reached a peaceful consensual solution to conflict. Based on this analysis, we present a model that can be applied to similar disputes. We conducted a review of relevant laws and judicial decisions and analyzed documents relating to disputes between the forestry company Veracel Celulose S.A. and family farmer associations between 2009 and 2016. Our findings show that, despite the fact that the normative base of the settlements is effectively grounded in the notion of the social function of property, absolutely no mention of the principle was made by the parties and legal actors during the process or in the agreements: the solution came about as the result of a consensus reached by two interested parties. This could therefore be said to be a case of “judicial redundancy”, whereby the key underlying legal principles relating to the social function of property were fulfilled without resorting to the courts.

Technologist in Environmental Sanitation from the State University of Campinas (2003); Master in Agroecology and Rural Development by the Federal University of São Carlos in partnership with Embrapa Meio Ambiente (2008); PhD in Sciences with emphasis on Applied Ecology by ESALQ - USP. He received a scholarship from the Franco-Brazilian Doctoral College Program (CAPES) and developed research activities at the Institut des Hautes Études sur l'Amerique latine - Sorbonne Nouvelle (Paris III), Paris - France. Developed a postdoctoral project by the University of São Paulo in the area of Applied Ecology. She is currently an effective professor at the Environmental Sciences Training Center at the Federal University of Southern Bahia on the Porto Seguro campus - BA. He has experience and works mainly on the following themes: ecology of agroecosystems, agroecology and organic production, food security and water security in rural and indigenous populations, protected natural areas.

PhD in Agricultural and Forestry Research at University of Santiago de Compostela [(USC) Spain]. Master in Agroecosystems (2010) at Universidade Federal de Sergipe [(UFS), Brazil]. Forest Engineering at Universidade Federal de Sergipe [(UFS) Brazil, 2008]. Computer technician at SENAC (Brazil). The researcher has experience in area of Forest Resources and Forest Engineering, with emphasis on the Conservation of Nature.

Emilia Rahnemay Kohlman Rabbani, Professor of Civil Engineering at Pernambuco University, Brazil - UPE

Postdoctorate in Civil Engineering from University of Minho (2012), Portugal, a Doctorate in Civil Engineering from the University of Pittsburgh (2000), a Master’s Degree in Civil and Environmental Engineering from the University of Pittsburgh (1998), a Bachelor’s Degree in Civil Engineering from the Federal University of Paraíba (1996), and a Bachelor’s Degree in Civil and Environmental Engineering from the University of Pittsburgh (1995). She has worked as a Traffic Engineer at Midwest Research Institute in Kansas City, Missouri, on a team of researchers in the area of transportation safety (2000–2002). She was a professor in the Department of Civil Engineering at the Federal University of Sergipe, Brazil (2003–2005), has acted as the Coordinator of the Civil Engineering Master’s Program (2010-2011) at the University of Pernambuco (Brazil), Leader of the Ergonomics and Occupational Safety and Health research group (2008-2011), and is presently representative of the Associate Professors at the Academic Management Council of the School of Engineering (CGA/POLI/UPE), the Leader of the Safe and Sustainable Development research group at UPE - DESS (2013-present) and Coordinator of the Culture Division at the UPE School of Engineering - POLI (2014-present). As an Associate and tenured professor at the University of Pernambuco, she teaches at the undergraduate level, and at the Master’s level in Civil Engineering having developed and thought more than 12 university courses. She received her full professor title (livre docente) in 2013 and supervised directly over 115 students among teaching and research undergraduate and graduate assistants, Masters and Ph.D. theses. She has over 120 full articles published in journals, proceedings or books. She has experience in the civil engineering area, with emphasis in transportation, sustainability and occupational health and safety, working principally with the following subjects: transportation safety, sustainable construction, and social sustainability applied to construction projects.
